Welcome to Pixel Hero (the "Service"), a platform provided by Crane X1 LLC dba Pixel Hero ("we," "us," or "our") that enables filmmakers to generate JSON prompts for use with artificial intelligence tools and store related assets. By accessing or using the Service, you agree to be bound by these Terms of Service ("Terms"). If you do not agree with these Terms, please do not use the Service.
1. Acceptance of Terms
By creating an account, accessing, or using the Service, you confirm that you are at least 13 years old, as required by U.S. law, and agree to comply with these Terms. If you are under 18, you must have parental or guardian consent to use the Service. We may update these Terms periodically, and continued use of the Service after changes constitutes acceptance of the updated Terms.
2. Use of the Service
Account Creation:
To access certain features, you must create an account with accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
Permitted Use:
You may use the Service to generate JSON prompts for AI tools and store related assets in accordance with these Terms. You agree not to:
- Use the Service for any illegal or unauthorized purpose.
- Attempt to reverse-engineer, decompile, or hack the Service.
- Upload or share content that is harmful, offensive, or infringes on others' rights.
Content Ownership:
Any JSON prompts or other content you create or upload using the Service ("User Content") remains yours. By uploading or generating User Content, you grant us a non-exclusive, worldwide, royalty-free, irrevocable license to host, store, process, review, market, and share successful prompts solely to provide, promote, and improve the Service.
3. Asset Storage
Storage Services:
The Service provides storage for files related to your JSON prompts and filmmaking projects. We strive to maintain reliable storage but do not guarantee uninterrupted access, quality of service, or prevention of data loss.
Waiver:
To the fullest extent permitted by law, we are not liable for any loss, corruption, or deletion of files stored on the Service, whether due to technical issues, user error, or other causes. You are responsible for maintaining backups of your files.
Prohibited Content:
You agree not to use the storage services to host or share illegal or prohibited content, including but not limited to pornography, child pornography, or any material that violates applicable laws or third-party rights. We reserve the right to remove such content and terminate accounts involved in such activities.
4. Intellectual Property
Our IP:
The Service, including its software, design, and branding, is owned by or licensed to Crane X1 LLC dba Pixel Hero and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without our prior written consent.
Your IP:
You retain ownership of your User Content, subject to the license granted above. You are responsible for ensuring your User Content does not infringe on third-party rights.
5. User Conduct
You agree to:
- Use the Service in compliance with all applicable laws and regulations.
- Not interfere with or disrupt the Service, including introducing viruses or malicious code.
- Not use the Service to generate, store, or share content that is defamatory, obscene, or otherwise objectionable.
6. Termination
We may suspend or terminate your account or access to the Service at our discretion, with or without notice, if you violate these Terms or engage in conduct we deem harmful to the Service or other users. Upon termination, your right to access the Service will cease, but these Terms' provisions on intellectual property, liability, and indemnification will survive.
7. Disclaimers
The Service is provided "as is" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or secure.
8. Limitation of Liability
To the fullest extent permitted by law, Crane X1 LLC dba Pixel Hero shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of data, profits, or business opportunities. Our total liability for any claim shall not exceed the amount you paid, if any, to use the Service.
9. Indemnification
You agree to indemnify and hold harmless Crane X1 LLC dba Pixel Hero, its affiliates, and their respective officers, directors, and employees from any claims, damages, or losses arising from your use of the Service, your User Content, or your violation of these Terms.
10. Governing Law
These Terms are governed by the laws of the State of Wyoming, without regard to its conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the courts of Sheridan County, Sheridan, Wyoming.
11. Miscellaneous
Entire Agreement:
These Terms, along with our Privacy Policy, constitute the entire agreement between you and Crane X1 LLC dba Pixel Hero regarding the Service.
Severability:
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
Assignment:
You may not assign your rights or obligations under these Terms without our prior written consent. We may assign these Terms at our discretion.
